Stat. § 605.0304): By accessing or using any website, interactive demonstration, client or event portal, digital business card, or consultation intake form operated by IC Studio LLC across icstudiollc.com, icstudiollc.netlify.app, or affiliated studio properties (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"), our Acceptable Use & Anti-Abuse Policy ("AUP"), and our Privacy Policy. All Services are provided solely by IC Studio LLC, a Florida limited liability company, and no individual member, manager, or architect bears personal liability in connection with the Services.

1.2 Intellectual Property Ownership (17 U.S.C. § 201): All source code, visual designs, 3D WebGL/Canvas shader compositions, interactive portal workbenches, autonomous workflow architectures, logos, trademarks, and downloadable briefs (including IC_STUDIO_LLC_CAPABILITIES_OVERVIEW.pdf) displayed on or powering the Services are the exclusive proprietary intellectual property of IC Studio LLC or its licensors. Automated scraping, reverse engineering, or unauthorized commercial reproduction is strictly prohibited.

1.3 No Unsolicited Confidential or Client Relationship: Submitting a project inquiry, quote request, or message through this website does not create a client-architect relationship, fiduciary duty, or non-disclosure obligation until a formal Non-Disclosure Agreement (NDA) or Master Services Agreement & Statement of Work (MSA/SOW) is mutually executed in writing by IC Studio LLC. Do not submit regulated health information (HIPAA PHI), payment card data (PCI-DSS), Social Security Numbers, or classified trade secrets through public website intake forms.

1.4 Conspicuous UCC § 2-316 "AS-IS" Disclaimer: ALL PUBLIC WEBSITES, INTERACTIVE PREVIEWS, CALCULATORS, AND INFORMATIONAL CONTENT ARE PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT (FLA. STAT. § 672.316). Commercial software deployments are governed exclusively by a mutually executed IC Studio LLC Master Services Agreement & Statement of Work (MSA/SOW).

1.5 Limitation of Liability, Arbitration & Exclusive Florida Venue: To the maximum extent permitted by law, total aggregate liability of IC Studio LLC for any claim relating to public website or demonstration use shall not exceed $100.00. Any dispute shall be resolved on an individual basis (with an express waiver of class or representative actions and trial by jury) exclusively in the state or federal courts serving Pasco County, Pinellas County, or Hillsborough County, Florida (Middle District of Florida) under Florida law.

2. Shared Responsibility, Applied AI & Regulatory Compliance Disclaimer

2.1 No Legal, Tax, or Medical Advice: IC Studio LLC is a software and systems architecture studio—not a law firm, CPA firm, or healthcare Covered Entity. Architectural previews, data-governance options, and workflow demonstrations on this website are provided for illustrative technical evaluation only and do not constitute legal or regulatory advice.

2.2 Shared Responsibility Model for High-Compliance & Applied AI Systems: While IC Studio LLC engineers custom software architectures, isolated deployment environments, and private AI workflows designed to support client security and regulatory requirements, final regulatory certification, operational data governance, human-in-the-loop verification of AI outputs, and execution of any required Business Associate Agreement (BAA) or Data Processing Addendum (DPA) are governed strictly by a written Master Services Agreement (MSA) between IC Studio LLC and the client organization.

3. Acceptable Use & Anti-Abuse Policy (AUP)

Neither any visitor, client, nor end-user may use any IC Studio LLC website, portal, email compiler, event application, or hosted system to engage in, foster, or promote any unlawful, abusive, or unauthorized activity, including:

• Unlawful Messaging & Spam (CAN-SPAM & TCPA): Unsolicited bulk commercial email, SMS, or telemarketing in violation of 15 U.S.C. § 7701 or the Telephone Consumer Protection Act.
• Unauthorized Access, Scraping & Security Probes (CFAA / CADRA): Vulnerability scanning, DoS/DDoS attacks, credential stuffing, or unauthorized automated scraping in violation of 18 U.S.C. § 1030 or Fla. Stat. § 815.06.
• Fraud, Phishing, Malware & Deceptive Practices (FDUTPA): Hosting or transmitting malware, phishing pages, or deceptive commercial claims.
• Unencrypted Regulated Data Uploads (HIPAA PHI / PCI-DSS): Uploading unencrypted Protected Health Information, Social Security Numbers, or raw payment card numbers into public intake forms.

Kill-Switch & Full Indemnification: IC Studio LLC reserves the right to immediately suspend or terminate any session or tenant instance upon reasonable suspicion of an AUP violation. Any party violating this AUP agrees to fully defend, indemnify, and hold harmless IC Studio LLC against 100% of all third-party claims, regulatory investigations, fines, and reasonable attorney's fees resulting from such violation.

4. Comprehensive Privacy Policy (FIPA / CCPA / TDPSA / GDPR)

4.1 Zero Data Brokerage & Zero Sale of Personal Information: IC Studio LLC respects your privacy. We never sell, rent, share for cross-context behavioral advertising, or trade your personal information or business contact details to third-party data brokers or ad networks.

4.2 Data Inventory & Collection Purpose:

• Voluntarily Submitted Inquiry Data: When you request a quote or submit an inquiry via #concierge, we collect your name/organization, email address, optional phone number, selected project pillars, timeline, and project notes strictly to respond to your inquiry and prepare your requested scope (Lawful Basis: Contract Pre-Performance & Legitimate Business Interest).
• Strictly Necessary Functional Storage: Your browser's localStorage stores only your selected reading theme (ic_studio_theme_v5) and text size preference (ic_studio_font_scale_v5) so the interface remembers your reading comfort settings across visits. Ephemeral sessionStorage (ic_studio_telemetry_ring_v3) holds non-identifying in-page interaction milestones for the current tab session only and is cleared when the tab closes.
• First-Party Cookieless Attribution & Infrastructure Security Logs: Our first-party serverless endpoints (/api/intake and /api/telemetry hosted on Netlify, Inc. and routed via Cloudflare, Inc.) record aggregate, cookieless first-party campaign attribution (such as UTM parameters, business card QR scans, and solution pillar views) alongside standard HTTP security metadata strictly for conversion measurement, DDoS mitigation, and bot-rate limiting. Zero visitor data is ever transmitted to third-party advertising networks or external analytics trackers.

4.3 Data Retention & Disposal Schedule (Fla. Stat. § 501.171 — FIPA): All data in transit is encrypted via TLS 1.3 (HTTPS). Prospective client inquiry records that do not result in an active commercial engagement are retained for no longer than twenty-four (24) months from last interaction and then securely purged.
